The U.S. Department of State (DOS) has released the March 2015 visa bulletin  showing very little movement in family based categories with oversubscribed visa numbers. Visa dates are announced by the DOS every month. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. Should it become necessary during the monthly allocation process to immediately retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date. If you have filed an employment based or family based immigrant petition (I-130 or I-140) it is important that you are aware of your priority date as you may be eligible to file for a green card (adjustment of status).

Family Based Categories-

Nearly all of the family preference categories have advanced by  1-2 months for most countries aside from Mexico and the Philippines.  The exception to advancement is the F3 category for married sons and daughters of U.S. Citizens which has only advanced by a few weeks for all countries. There are many different categories in which U.S. Citizens can sponsor their family members. This includes the F1 category for Unmarried Sons and Daughters of U.S. Citizens, the F2A category for Spouses and Children of Permanent Residents, the F2B category for Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents, the F3 category for Married Sons and Daughters of U.S. Citizens, and finally the F4 category reserved for the Brothers and Sisters of Adult U.S. Citizens.

While we hope to see relief for those waiting in all countries there are still major backlogs for both Mexico and the Philippines  leaving those family members in the F-4 categories who filed back in 1997 and 1991 an extensive amount of time (25 years)before their numbers become available. We hope that all families awaiting the immigration of their loved ones find relief in the future.

Employment Based Categories-

We are pleased to see an advancement of six months in employment based 2nd (EB-2) preference categories for China. February’s EB-2 category had priority dates for China’s EB-2 category stuck at March of 2010 however this month they have advanced to September  of 2010. Nearly 6 months! There is even better news for India’s EB-2 Category. India’s February visa bulletin numbers in EB-2 Category were stuck with priority dates of September 2005. It is amazing how much advancement comes for March as the India EB-2 category priority dates are now at January 2007.

Although the EB-2 advancement of priority dates is wonderful, we remain extremely disappointed with the lack of advancement in EB-3 category. Visa numbers for China and India have only advanced by a few weeks while all chargeability areas, including Mexico and the Philippines continue to advance at a greater rate. Many H-1B visa holders can apply for permanent residence through their employers. There are many immigration law firms in Orange County which specialize in PERM Labor Certification. It is that time of year again…the season for H-1B filings. We are encouraging those who are interested in applying to contact our office immediately for a free consultation. Last year the U.S. Citizenship & Immigration Services (USCIS) received over 124,000 H-1B visa petitions. The USCIS will begin accepting H-1B petitions on April 1, 2015. Depending on the amount of applicants  received by immigration, this will determine the length of the filing period. In the past, the filing period has been only seven days between April 1st to April 7th. Petitions which are accepted into the H-1B lottery and approved under this year’s cap will be able to begin work as early as October 1, 2015.

Every year, the U.S. Citizenship and Immigration Services (USCIS) receives an extraordinarily high number of H-1B petitions and is required to run a computer generated H-1B lottery. Those selected for processing will be receipted by U.S. Department of Homeland Security (USDHS) and fees taken. Those whose numbers are not selected will receive their petition back along with the USDHS government filing fees. The H-1B program has a regular, or base, cap of 65,000, with another 20,000 visas for those who earned a U.S. master’s degree or higher. In past years caps were met  within a week to two weeks time. As you can well imagine with only 65,000 numbers available and over 124,000 applicants it is vital that you are timely submitting your petition. There has been a consistent high demand for H-1B visas in tech hiring. Nearly 60% of all H-1B petitions approved go to people in computer-related occupations. With advancements in modern technology including the high volume of android, iphones, tablets, and cloud technology it is no surprise that the majority of H-1B petitions are used towards computer-related occupations. An even greater part of the H-1B visas in the computer-related occupations will go to large companies like Microsoft, Google, and Apple.

While the majority of types of professions receiving H-1B visas include physicians, pharmacist, physical therapists, occupational therapists, speech language pathologists, teachers, lawyers, engineers, and professors, accountants, and other professions requiring degrees or licensure.

The president delivered his sixth State of the Union address at a joint session of Congress on Jan. 20, 2015. President Obama addressed many of the accomplishments of his administration as well as addressed points on improving the economy. The president also discussed his commitment to improving the Federal minimum wage and paid leave for American workers discussing both a need for paid family leave as well as sick leave. In addition, it is the hopes of President Obama that Congress will provide opportunities for tax credits for working families and 2 years of community college free.

The U.S. Citizenship & Immigration Services has issued a friendly reminder to beneficiaries of Deferred Action for Childhood Arrivals (DACA) that if you are requesting either initial or renewal of your DACA status, you must submit Form I765, Application for Employment Authorization and required fees. USCIS will reject your request if you fail to submit Form I765, the required filing fee, Form I765 Worksheet, and Form I821D.

California recently began processing applicants who are unable proof of legal status in the U.S. Driver’s licenses under AB 60. Applicants must meet all other qualifications for licensure and must provide satisfactory proof of identity and California residency. For those citizens of Mexico without a Birth Certificate the consulates of Mexico in the United States will begin issuing copies of birth certificates registered in Mexico. To obtain a certified copy, Mexican nationals should visit the nearest consulate, present an official proof of identity, fill out an application and provide their Clave Única de Registro de Población (CURP) in case they have one. The cost of each certified copy will be $13.00 dollars.
